Stalking Defense in the Villages

Work Directly with Attorney Fisher on Your Stalking Defense

A stalking accusation may involve both a criminal charge and a separate civil injunction. Each has its own allegations, court orders, and deadlines. At Law Office of Jody L. Fisher, we defend people accused of stalking and aggravated stalking in The Villages while addressing civil-order issues that could affect the prosecution.

Attorney Jody Fisher brings more than 20 years of legal experience to this work. She began her career with the Fifth Judicial State Attorney’s Office in Marion County and later handled juvenile, misdemeanor, and felony matters for the Sumter County State Attorney’s Office. After prosecuting hundreds of cases, she entered private practice in criminal defense and family law.

Our practice is small by design, so clients work directly with Attorney Fisher rather than being handed off to junior staff.

Florida Stalking & Aggravated Stalking Charges

Florida law treats stalking and aggravated stalking as distinct offenses. Stalking generally involves willfully, maliciously, and repeatedly following, harassing, or cyberstalking another person. It’s classified as a first-degree misdemeanor.

In this context, harassment means a course of conduct directed at a particular person that causes substantial emotional distress and serves no legitimate purpose. We examine whether the alleged actions were repeated, directed at the person, and without a legitimate purpose rather than treating every unwanted interaction as criminal stalking.

Credible Threat Allegations

Aggravated stalking generally combines alleged stalking conduct with a threat and is classified as a third-degree felony. Under Florida law, a credible threat may be verbal, nonverbal, electronic, or implied. It must place the target in reasonable fear for personal or family safety when the accused appears able to carry it out, making the context and sequence of the alleged words or actions important.

Florida law also classifies repeatedly following, harassing, or cyberstalking a child younger than 16 as aggravated stalking. Because this allegation doesn’t depend on the same threat theory, the person’s age and the nature of the alleged conduct become central issues.

Potential No-Contact Restrictions

A conviction can carry consequences beyond the classification of the offense. A sentencing court considering a stalking conviction must consider a no-contact restraining order, which can remain valid for up to 10 years. The precise consequences depend on the charge, the facts, and the court’s rulings.

Criminal Charges & Civil Stalking Injunctions

A civil stalking injunction is a protective order, not a criminal conviction. It proceeds separately from a prosecution, even when both arise from the same alleged communications or conduct. An arrest and an injunction petition can therefore require responses in two different courts.

The legal standards also differ. A Florida injunction may be based on a single stalking incident, while a criminal stalking charge requires alleged repeated conduct. The petition and criminal allegations must be reviewed separately because one proceeding doesn’t necessarily determine the other.

Compliance with any temporary or final injunction is critical while it remains in effect. A violation can lead to arrest and a separate charge. Repeated stalking conduct after an injunction or another court-imposed prohibition may be charged as aggravated stalking, a third-degree felony.

Jurisdiction for Stalking Cases in the Villages

The Villages spans Sumter, Lake, and Marion counties within the Florida Fifth Judicial Circuit. The county that handles an arrest or prosecution generally depends on where the alleged conduct occurred. Electronic communications, in-person encounters, and events crossing county boundaries can make that location question especially important.

Attorney Fisher’s prior work in the Sumter County State Attorney’s Office and the Fifth Judicial State Attorney’s Office in Marion County informs how we examine charging decisions, the prosecution’s theory, and the supporting evidence.

Our Stalking Defense Process

We begin by identifying whether the client faces a criminal charge, a civil injunction petition, or both. We also review active court conditions, including any no-contact order, so the defense strategy accounts for every legal obligation.

Our defense process includes five stages:

  • Initial Consultation: We discuss the accusation, known court proceedings, and the client’s immediate concerns.
  • Investigation: We examine available communications, electronic records, witness accounts, and the sequence of alleged events.
  • Defense Strategy: We assess the evidence and distinguish alleged repeated conduct, harassment, and any claimed threat.
  • Representation: We advocate for the client throughout the applicable prosecution and address injunction concerns within the scope of our representation.
  • Post-Trial Support: We assist with relevant issues that remain after trial.

An injunction petition requires close attention to its allegations, the scheduled hearing, and the evidence presented to the court. A prosecution requires a separate review of the charged offense, underlying conduct, and court-imposed conditions. We work directly with each client so these factual and procedural distinctions aren’t lost.

Discuss Your Stalking Allegation Confidentially
